FEC Puts New Limits on Political Groups but Leaves Room for "Soft Money" Spending

The Federal Election Commission (FEC) issued a ruling Feb. 18 that non-party political organizations must use regulated "hard money" for activities that "promote, attack, support or oppose" federal candidates. The 4-2 ruling further stated that outside political organizations could use a mix of hard and soft money for activities that benefit federal, state and local candidates.

The FEC decision came in response to an advisory opinion request from a Republican 527 group called Americans for a Better Country (ABC), seeking clarification on the extent to which activities by outside political groups could be funded with soft money. The nations’ new campaign finance law, the Bipartisan Campaign Reform Act, restricts unlimited soft money contributions to political parties, but leaves open the flow of big money donations to outside political groups organized under Section 527 of the tax code.
