ASAE to Hold Interactive Town Hall Meeting on the FTC's CAN-SPAM Act
ASAE will hold an interactive Town Hall meeting on the Federal Trade Commission’s (FTC) proposed rules defining commercial e-mail on October 1, 1:00 p.m. - 3:00 p.m. ET, at The Conference Center at ASAE in Washington, DC or via audio-conference. In short, the FTC would consider a wide array of association e-mails – including those about a conference registration or a new book on industry best practices, for example – “commercial,” under its proposed rules.
Panelists at the program will include the primary author of the FTC’s proposed rules, Michael Goodman, staff attorney for the FTC; and attorneys for ASAE and The Center for Association Leadership, Jeffrey Tenenbaum, partner, Venable LLP, and Jefferson Glassie, partner, Shaw Pittman LLP.
As reported by Inroads, the FTC published a Federal Register notice Aug. 13 seeking public comment on the proposed criteria for determining the “primary purpose” of an e-mail message. ASAE plans to file comments, but other interested parties can file electronically before Sept. 13 at the following Web site: https://secure.commentworks.com/ftc-canspam/.

FEC Adopts Limited New Rule Regulating 527s
Under pressure for months to curb the “soft money” spending of Section 527 political groups, the Federal Election Commission (FEC) voted to adopt a limited new rule requiring some groups to use federally regulated “hard money” to pay for at least 50 percent of their expenses, including salaries, rent and other overhead.
Apart from the FEC action, the Internal Revenue Service (IRS) announced new steps last week designed to improve reporting and disclosure by 527 groups. The new initiative will involve contacting 527 groups whose filings appear to be incomplete, were filed late, or were amended and are materially different from the original filing. Martha Sullivan, IRS Director of Exempt Organizations, said, “The statute is very clear that those tax-exempt political organizations reporting to us must make the required disclosures in a timely, accurate manner. The IRS is working to make sure this important information is available this fall and that these groups meet their public reporting responsibilities.”
