Nonprofit Protections Added to Homeland Security Appropriations

The Senate approved a Homeland Security appropriations bill last week with $50 million in assistance for 501(c)(3) nonprofits determined to be at high risk of international terrorist attacks.

The House passed its version of the bill (H.R. 4567) on June 18. The measure now goes to a House-Senate conference committee. ASAE is part of a coalition of nonprofits working to ensure the entire $50 million stays in the final legislation. The Coalition for High-Risk Non-Profit Security sent a letter to conference committee members this week offering a number of compelling reasons for dedicating homeland security funds to nonprofits, most notably the fact that nonprofits cannot afford to divert funds for security measures and still fulfill their social, community and educational missions.

On January 1st, the new federal spam law took effect, with a potentially significant impact on associations, depending on how the Federal Trade Commission defined commercial e-mail. The FTC has given its preliminary answer, and it is not the answer associations were seeking. If an e-mail markets something -- be it a conference registration or a new book on industry best practices -- it is 'commercial,' according to the FTC's proposed rules, no matter what the source (nonprofit or for-profit), what is being sold (related or unrelated to nonprofit purposes), or to whom it is sent (member or non-member).

The rules apply to a single e-mail equally as they do to bulk e-mail. In short, a wide array of association e-mails would be considered 'commercial' under the FTC proposal, with significant requirements that apply. Join us for a special town hall meeting on the proposed rules and learn what your association needs to do to comply before the rules are finalized in December.
