FCC to Vote on Petition for Stay of Fax Regulations
ASAE and the Fax Ban Coalition have learned that the Federal Communications Commission (FCC) has called for a rolling vote on the Petition for Stay of the FCC’s proposed fax regulations. Once all five commissioners vote, the results should be made known.
ASAE and the coalition filed the petition in August seeking a new six-month stay of the proposed fax rules, otherwise due to take effect January 1, 2005. As ASAE has previously reported, legislation reinstating the “established business relationship” provision desired by associations and the business community fax issue has found bipartisan support in both chambers, with the Senate Commerce, Science and Transportation Committee passing S. 2603 on July 22, and H.R. 4600 passing the full House on July 20. But the upcoming elections and the scramble to pass funding bills for various agencies has dominated Senate discussions of late, and time is running out in the current legislative session.
That said, it is still very important for ASAE members to contact their Senators to urge them to vote for S. 2603 when it goes to the Senate floor for a full vote. To contact your Senators, visit the ASAE Web site at http://capwiz.com/asae/issues/alert/?alertid=6096556.
The coalition responded to a Washington Post article last week in which consumer advocates suggested that the fax bill would open loopholes leading to more junk faxes. In a letter to the editor submitted today, the coalition points out that no new right to fax is created by the fax legislation; rather, the bill simply restores the “established business relationship” provision for faxing that the FCC originally endorsed before drafting new regulations last summer.
