Have Your Voice Heard on Fax Ban Issue
Now is the time to add your voice to the growing list of organizations pushing for Senate action on S. 2603, the bill that restores the "established business relationship" provision so that legitimate, business-to-business and association-to-member fax communications can continue unimpeded.
While the Federal Communications Commission (FCC) has granted a new six-month stay of its proposed fax regulations, until July 1, 2005, a permanent legislative solution is still needed. Unfortunately, the Senate failed to act on the legislation before they adjourned for the elections. Because of legislative procedures, the Senate pursued unanimous consent to pass S. 2603. At that time, only Sen. Barbara Boxer (D-CA) objected to the bill, preventing its passage. It is extremely important for all ASAE members, whether living in California or not, to contact Sen. Boxer at any of her offices with the simple message to please support passage of S. 2603.
It is the hope of ASAE and The Fax Ban Coalition that the Senate will consider this legislation during the lame duck session scheduled to begin November 16. Please visit ASAE’s Advocacy Center at http://capwiz.com/asae/issues/alert/?alertid=6096556 to send a personalized message to Sen. Boxer. The Fax Ban Coalition and ASAE also believe it very important to have other members of the Senate, particularly Democratic Senators and colleagues of Sen. Boxer, to personally contact her and ask her to drop her objections and pass S. 2603. We would therefore urge any association executive comfortable making a personal request to their Senator to please do so. CAN-SPAM Act Resource Page Added to ASAE Web Site Still unclear on which of your association’s e-mail messages might fall under the “commercial” category, as defined by the Federal Trade Commission (FTC)? ASAE has created a resource page for you on its Web site, accessible at http://www.asaenet.org/asae/cda/index/1,1584,ETI20735_MEN3_NID4971,00.html. The CAN-SPAM Act of 2003 (S.877) went into effect January 1, 2004. Though the legislation was crafted to restrict the peddlers of pornography, false business opportunities, and those who use fraudulent or deceptive marketing practices, there are some implications for the association community in the FTC’s proposed rules implementing the new law. In short, the FTC interprets a wide array of association e-mails as “commercial,” including those about a conference registration or a new book on industry best practices, for example. On ASAE’s CAN-SPAM Act resource page, you will find “Frequently Asked Questions” about the law, ASAE’s comments filed with the FTC, as well as an article on how the proposed rules would impact associations prepared by the law firm Venable, LLP.
