Nonprofits Assist in Tsunami Relief Efforts
The large-scale devastation resulting from the tsunami disaster in South Asia has spawned a tremendous outpouring of relief from the U.S. and internationally, including offers of assistance from many of ASAE members’ associations and industry partners.
ASAE and The Center for Association Leadership are urging their staff, volunteers and members to support the private fundraising efforts being chaired by former Presidents George H.W. Bush and Bill Clinton and explore the numerous ways Americans can assist in relief efforts at the USA Freedom Corps Web site (http://www.freedomcorps.gov). ASAE and The Center also announced this week they would match all employee donations to any of the charities listed on the Freedom Corps Web site up to $25,000.
In related news, legislation was passed unanimously in both the House and Senate that allows individuals to claim a tax year 2004 deduction for charitable donations to tsunami relief organizations made during January 2005.

Question of the Week—Nonprofit Organization Governance
What changes are in store for nonprofit organization governance?
There has been much discussion within the nonprofit sector of applying “Sarbanes-Oxley” provisions to nonprofits, and ASAE wishes to clarify that, outside of two provisions, the American Competitiveness and Corporate Accountability Act of 2002, also known as the Sarbanes-Oxley Act, is applicable only to publicly traded companies that are regulated by the Securities and Exchange Commission (SEC).
However, ASAE has noted increasing scrutiny of issues related to nonprofit governance. At its essence, the attention on nonprofit organizations from Congress, from regulators, from attorneys general at the state level, and from the media and general public, boils down to a desire to see nonprofits (particularly charities and foundations) safeguard against potential abuse and enhance their accountability in ways that ensure public trust.
While supportive of the need for solid financial controls and transparency in the nonprofit community, ASAE believes there is sufficient cause for concern in the current agendas of the Senate Finance Committee, House Ways and Means Committee, the IRS, and in state attorneys general offices - all of which have shown interest in curbing real or perceived abuse in the nonprofit sector. While most of the attention to date has centered on charities and foundations, ASAE is concerned that other types of nonprofits, particularly trade and professional groups, might be “painted with the same brush” in any proposed reforms.
ASAE will continue to monitor this issue in 2005 in an effort to protect the ability of all exempt organizations to carry out their vital missions.
