Joint Committee on Taxation (JCT) Report Includes Revenue Increases Applicable to Exempt Organizations

A 435-page report, released by the JCT last week, includes 69 revenue-raising provisions to reduce the size of the tax gap. At least 12 of these are applicable to tax-exempt organizations, and many are similar or identical to provisions included in the Senate Finance Committee staff discussion draft on nonprofit and charity reforms released last summer.

The JCT report was prepared at the request of Senate Finance Committee Chairman Chuck Grassley (R-IA) and Ranking Member Max Baucus (D-MT), and may be used as the basis for forthcoming legislation. A majority of the revenue-raising provisions that would apply to exempt organizations targets the 501(c)(3) community specifically, but several may have implications for the entire tax-exempt sector. Organizations with annual total gross revenues or assets of at least $10 million would have to include a certification from an independent auditor or independent counsel with their Form 990 and 990-T filings. The JCT estimated that this change would raise less than $50 million.
