ASAE Meets With IRS Exempt Organizations’ Chief

ASAE President and CEO John H. Graham IV, CAE, along with ASAE Public Policy staff, met with Martha Sullivan, director of the IRS’ Exempt Organizations (EO) Division, met to discuss a number of ongoing issues affecting the tax-exempt community.

Sullivan told ASAE the IRS is "about halfway through" its Tax Exempt Compensation Enforcement Project, a process that involves contact with some 2,000 charities and foundations in an effort to identify and halt excessive compensation practices in the tax-exempt sector. As reported this summer by Inroads, contact by the IRS does not necessarily imply improper activity by an organization; rather, the project’s objective is to simply gather information about current practices. The contact process involves scrutiny of compensation of specific officers and various kinds of insider transactions, such as loans and any sales, exchanges or leasing of property to officers and others.

Sullivan also said the EO Division continues to consider modifications to the Form 990 filed by tax-exempt groups. A discussion draft prepared by Senate Finance Committee staff last summer recommends reforms to improve the scope and quality of the Form 990 and ensure more accurate and complete reporting from exempt organizations. Also discussed at this week’s meeting was the issue of unrelated business income (UBIT) and Internet-related activities by exempt organizations.
