AHP Bill Passes House Committee

AHP Bill passes house committee: Legislation allowing the formation of association health plans (AHPs) cleared a hurdle with last week's passage by the House Education & the Workforce Committee on a party-line vote. The bill (H.R. 525) will now move to the House floor, probably sometime shortly after legislators return from spring recess.

The “Small Business Health Fairness Act” introduced in the House Feb. 2, would allow small businesses to pool together through their trade associations and negotiate health care coverage for their employees and their families at lower rates.
AHPs are a priority issue for ASAE and its coalition of grassroots advocates who will visit their members of Congress April 6–7 for American Associations Day and ASAE’s annual Legislative Fly-In program.

Question of the Week–Liquor Liability

We need information on liquor policies at association meetings.

The ASAE Listservers are a great resource to review what other associations executives are saying or doing about specific topics.  To read the postings...

  • Log in at www.asaenet.org as a member;

As far as liquor liability insurance specifically is concerned, there was some discussion of this on the ASAE Legal Section listserver.  Here's the response:

The law has not appreciably changed in the last 10 years. More than 40 states recognize commercial server liability, either by statute or common law. About 25 states recognize social host liability (i.e., that of unlicensed servers).  Factual issue is largely one of control, i.e., who controls dispensing of alcohol and how tightly is it controlled.

We suggest to all our clients that a provision be included in all hotel contracts assigning responsibility for compliance with state liquor laws to the hotel, specifically stating that they will not serve anyone under 21 or who appears to be intoxicated and that they have authority to cease serving. Also include provision requiring hotel to carry liquor liability insurance and indemnify association for any liability caused by their serving alcohol and, requiring hotel servers to undergo server training.

The risk is greater where attendees will drive after a meeting or event. Where most are from out of town and simply take the elevator to their rooms, the risk is greatly minimized. A majority of states that hold servers liability do not allow the intoxicated individual to recover.
