Fax Bill Passes Senate Commerce Committee

The Senate Commerce Committee passed S. 714, the “Junk Fax Prevention Act of 2005,” by a voice vote last week. The bill overturns the Federal Communications Commission’s (FCC) proposed new regulations governing facsimile communications, and would instead codify into law the “established business relationship” (EBR) exception to sending commercial faxes. The bill would also implement a mandatory opt-out requirement. 

The bill, introduced on April 5 by Sen. Gordon Smith (R-OR), was also originally co-sponsored by Senate Commerce Committee Chairman Stevens (R-AK), Ranking Member Inouye (D-HI), and Senators Sununu (R-NH), Burns (R-MT), Snowe (R-ME), Dorgan (D-ND) and Lautenberg (D-NJ). 

The bill passed with two minor amendments: one that requires the opt-out be available to recipients 24-hours-a-day, seven-days-a-week; and another that changes the time–from 18 months to three months–for the FCC to study whether a time limit on the EBR is necessary. For more information on the bill, please visit the ASAE Web site at http://capwiz.com/asae/issues/bills/?bill=7363801.

ASAE and the Fax Ban Coalition have begun conversations to determine when potential Senate floor action might take place. ASAE also expects the House to introduce companion legislation to S. 714 soon. ASAE and the coalition are also preparing to file a new extension request with the FCC.

ASAE Launches New Industry Benchmarking Survey

ASAE has launched a new online survey that will collect information about 18 association functional areas for the new edition of Policies and Procedures in Association Management.

The survey information will be published by ASAE as a series of function-specific monographs.  The functional areas of the study include: organization profile and structure; governance; financial management; human resources; office management; membership & dues; member benefits & services; education/professional development; conventions & meetings; publications; marketing; communications; advertising; public relations; research; government affairs; legal; technology; component relationships; international activities and certification & accreditation.  Survey participants will receive 30% off the regular member discount on the monographs for which they provide information.

Question of the Week–Executive Search Firm Fees

What are the average fees executive search firms charge clients?

According to 2003 data from the International Association of Corporate and Professional Recruitment, 86% of the search consultants surveyed charge fees over 30% of the client's compensation package.

Of the eight recruiters interviewed, two said they would not fill positions
involving a salary of under $60,000 (indicating a fee of $20,000). This was the
lowest salary cited by a recruiter willing to reveal his minimum salary figure.
Leonard Pfeiffer IV, a partner at Heidrick & Struggles, with the highest minimum
salary requirement, says he prefers doing searches for jobs paying $165,000 or
more (and thus a fee of at least $55,000). Occasionally recruiters will fill
association positions with a salary of greater than $1 million.
