FCC Requests Comments on Fax Ban Coalition Petition

The Federal Communications Commission (FCC) has officially requested public comment on the petition filed by ASAE and the Fax Ban Coalition asking for a declaratory ruling relating to the California fax law set to go into effect Jan. 1, 2006.

ASAE and the Fax Ban Coalition filed its petition Nov. 7 asking the FCC to assert its jurisdiction over interstate fax advertisements before the California law takes effect. The coalition has argued that states lack the jurisdiction to regulate interstate communications. The public comment period lasts for 30 days after publication in the Federal Register, which occurred on Dec. 14. Comments may be filed on the Federal Register Web site here

The California fax law prohibits fax advertisements into and out of the state without prior consent, and conflicts with federal law carving out an exemption for unsolicited fax advertisements in cases where the sender has an “established business relationship” with the recipient. Although the California law contains a limited exception for faxes sent by nonprofit professional or trade associations, many associations have protested the restriction on behalf of their members.

Because it appears the public comment period will extend past the date on which the California law becomes effective, associations may choose to begin preparing to comply with the restrictions on faxes originating from or sent to any California fax machine.

As previously reported in Inroads, a lawsuit challenging the California fax law has also been filed in U.S. District Court for the Eastern District of California. Plaintiffs, led by the U.S. Chamber of Commerce, are attempting to get an expedited hearing or a temporary restraining order prior to the law’s effective date of Jan. 1, 2006. ASAE will relay important developments on this issue as they occur.
