Senate Passes Lobbying Reform
After months of committee hearings and markups, the Senate overwhelmingly passed on March 29 a lobbying reform bill (S. 2349), the first overhaul of rules governing lawmakers’ interactions with lobbyists in more than a decade.
The Senate vote was 90-8, although the bill still had some detractors who felt the final product was watered down. Senate Majority Leader Bill Frist (R-TN) acknowledged the bill was “not perfect,” but added, “It is a step forward.”
Among the bill’s provisions are rules to enhance public disclosure of lobbyist activities, including; new disclosure requirements for grassroots lobbying; banning gifts and meals from registered lobbyists to senators and staff; requiring enhanced disclosure and Ethics Committee pre-approval for privately-funded travel; slowing the “revolving door” for former lawmakers and Hill staffers who become lobbyists; and reforming the earmarking process to cut pork-barrel spending.
ASAE provided written testimony at the committee level and aggressively communicated its opposition to a total ban on privately funded congressional travel because of the impact that would have on members of Congress and their staff attending association meetings and conferences for educational purposes. Senate Rules Committee Chairman Trent Lott (R-MS) echoed ASAE’s argument against a total ban earlier last month when he said it would be “counter-productive to outright ban all third party-funded travel because most of it consists of educational, matter-of-fact conferences which help your elected officials better understand the issues of the day.”
Before approving the final package, senators rejected or sidelined a number of amendments, including a proposal to create an independent Office of Public Integrity to enforce lobbying rules and another requiring lawmakers to pay charter rates when flying on corporate jets.
Also tabled during the debate last week was a proposal by Sen. Russell Feingold (D-WI) that would have defined a lobbyist as anyone working for a company or organization that employed registered lobbyists. Feingold said he was trying to eliminate a potential loophole in the gift ban where a lobbyist could invite a lawmaker or staffer to dinner or a sporting event as long as someone else working for the organization picked up the tab. Opponents said the proposal went too far, and would subject millions of people to possible fines if they unknowingly broke the rule.
