The FTC Issues Final E-mail Rules: What Every Association Needs to Know

Last month, the Federal Trade Commission (FTC) issued its final rules, which take effect in February, implementing a key aspect of the year-old federal spam law. According to the FTC, any e-mail message intended to sell something may be treated as a "commercial" message and is subject to the CAN-SPAM Act's requirements, regardless of whether it is sent by a for-profit or nonprofit entity. Although the FTC declined to create a blanket exemption for messages sent by nonprofits (as many had hoped), certain association e-mails to members may fall outside the Act’s definition of “commercial” messages.
